Terms, Legal Information and Age Policy

1. Website operator

This Website is operated by OPBH Group s. r. o., a limited liability company established under the laws of the Slovak Republic.

2. Nature of the Website

The Website offers age-restricted nicotine products and related devices. Products may include vaping devices, cartridges, e-liquids, disposable products and tobacco-free nicotine pouches or other smokeless products, depending on legal availability in the customer’s destination.

The Website is intended only for persons who are at least 18 years old and who may lawfully purchase, import, possess and use the relevant products in their country or region.

3. Customer communications

Questions, complaints, withdrawal notices and privacy requests may be sent to ruffyelf@gmail.com. Customers should include their name, order number and a clear description of their request.

Orders placed through Telegram or another messaging channel are governed by the same legal terms when the order is accepted by the Seller.

4. Supervisory and dispute-resolution information

Consumers should first contact the Seller and request a remedy. If a Slovak consumer dispute cannot be resolved directly, the consumer may be entitled to use an alternative dispute resolution body.

The former EU Online Dispute Resolution platform was discontinued on 20 July 2025. Consumers may instead use the national or cross-border consumer redress channels available in their country.

1. Scope and acceptance

These Terms and Conditions govern the use of https://elfruffy.com and purchases from OPBH Group s. r. o. (the “Seller”, “we”, “us” or “our”).

By using the Website or placing an order, you confirm that you have read and accepted these Terms. If you do not agree, do not use the Website or place an order.

Mandatory consumer law applicable in the customer’s country of habitual residence remains unaffected. Business customers are not entitled to consumer-only rights unless mandatory law provides otherwise.

2. Age restriction and eligibility

You must be at least 18 years old and legally permitted to purchase the products in your location. We do not sell or deliver regulated products to minors.

A simple age declaration or tick box is not treated as sufficient verification. We may use an online age and identity verification provider, such as Yoti, Veriff or another comparable service, and may require age verification again at delivery.

The name used for the order, payment and delivery must correspond. We may reject or cancel an order when age, identity or delivery eligibility cannot be verified.

3. Product availability and destination restrictions

Products are offered only where their sale, cross-border distance sale, import, delivery and possession are lawful. Availability may differ by destination, product type, nicotine concentration, flavour, container size or device specification.

Displaying a product on the Website does not guarantee that it can lawfully be sold or shipped to every listed destination. We may block products, refuse an order, request additional documents or cancel an order to comply with applicable law, carrier rules, payment-provider rules or regulatory requirements.

The customer is responsible for complying with local possession and use rules. This does not exclude the Seller’s own legal obligations as a trader.

4. Product information

We aim to describe products accurately. Images may differ slightly from the final packaging, colour or batch. Product packaging, warnings and instructions supplied with the product form part of the product information.

Nicotine strength and quantity should be checked before purchase. Do not use a product if its packaging is damaged, its origin is uncertain or the product appears unsafe.

5. Ordering process and contract formation

An order submitted through the Website, Telegram bot or another approved channel is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily constitute acceptance.

A binding sales contract is formed when we send an order acceptance or dispatch confirmation, or when we dispatch the goods, whichever occurs first.

We may refuse or cancel an order before dispatch for legal restrictions, failed payment, suspected fraud, failed age verification, pricing errors, unavailable stock or delivery limitations. If payment has been received, the relevant amount will be refunded.

6. Prices, taxes and customs

Prices are shown in the currency displayed at checkout. The checkout will show the product price, shipping charge and any taxes collected by us before the order is submitted.

For international deliveries, the customer may be responsible for import duties, local taxes, customs charges, permits or brokerage fees unless checkout expressly states that these are included. Refusal to pay destination charges may result in return, destruction or seizure of the parcel, subject to applicable law.

7. Payment

Available methods may include Paytriot Payments, bank transfer to an IBAN, authorised peer-to-peer payment, Apple Pay and Google Pay. The methods displayed at checkout are the methods available for that order.

Payment may be subject to verification by the payment provider. We do not normally receive complete payment-card details. Orders are processed only after successful payment and any required age verification.

The customer must use a payment method they are authorised to use. Fraudulent or disputed payments may be reported to payment providers or competent authorities.

8. Shipping and delivery

Paid and verified orders are normally processed within 1 to 3 business days before dispatch. Delivery time begins after dispatch and depends on destination, carrier, customs and regulatory checks.

Shipping is arranged through GLS, DPD or another carrier or shipping aggregator shown at checkout. Shipping charges are calculated before payment where technically available.

Delivery may require adult signature or identity and age verification. Regulated products must not be handed to a person under 18 years old.

9. Right of withdrawal

Consumers in the European Economic Area generally have 14 days after receiving eligible goods to withdraw from a distance contract without giving a reason, subject to statutory exceptions.

The withdrawal right does not apply after the protective seal has been broken on goods that are unsuitable for return for health protection or hygiene reasons. This may include opened e-liquids, nicotine pouches or snus-style products, pre-filled pods, mouthpieces and similar consumables.

The consumer normally bears the direct return shipping cost for a change-of-mind return. The Returns, Refunds and Complaints Policy and Model Withdrawal Form provide the procedure.

10. Faulty or non-conforming goods

Consumer statutory guarantee rights are not limited to 14 days. For goods sold to EU consumers, the minimum legal guarantee is generally two years from delivery, and longer or different mandatory periods may apply in some countries.

Where a product is defective or not as agreed, the customer may be entitled to repair or replacement free of charge and, where legally applicable, a price reduction or refund. We may reasonably request photographs, video, diagnostic information or return of the product to verify the defect.

For an accepted defect claim, we bear reasonable return and replacement shipping costs. This does not cover damage caused by misuse, liquid ingress, incompatible accessories, unauthorised repair, accidental damage or normal wear, unless mandatory law provides otherwise.

11. Safe use and nicotine warning

Nicotine is addictive. Products are intended only for adults. They must be kept away from children and pets and used only according to the manufacturer’s instructions and applicable warnings.

Products are not medicines and are not offered as a treatment, diagnosis or guaranteed smoking-cessation method. Persons who are pregnant, breastfeeding, sensitive to nicotine or affected by a medical condition should seek professional medical advice before using nicotine products.

12. Intellectual property and Website use

Website content, branding, layout, text, graphics and software are protected by intellectual property laws. You may use the Website only for lawful personal or business purchasing purposes.

You must not interfere with Website security, scrape data at scale, submit fraudulent information, impersonate another person or use the Website to facilitate unlawful resale or supply to minors.

13. Liability

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, wilful misconduct or mandatory consumer remedies.

To the extent permitted by law, we are not liable for indirect or unforeseeable loss, loss caused by unlawful import or use, customer misuse, carrier or customs action outside our reasonable control, or a failure caused by events beyond our reasonable control.

For business customers, our aggregate contractual liability is limited to the amount paid for the relevant order, except where such a limitation is prohibited by law.

14. Complaints and dispute resolution

Complaints should be sent to ruffyelf@gmail.com. We will acknowledge and assess them within a reasonable time and may request supporting evidence.

Consumers may use the competent alternative dispute resolution body after first attempting to resolve the matter directly with us. Details for the Slovak Trade Inspection are included in the Legal Notice.

15. Governing law

These Terms are governed by Slovak law. For consumers, this choice does not deprive them of mandatory protections granted by the law of their country of habitual residence.

Courts and authorities competent under applicable consumer and private international law retain jurisdiction.

16. Changes and contact

We may update these Terms for legal, technical or operational reasons. The version in force when an order is accepted governs that order unless mandatory law requires otherwise.

Age Verification and Nicotine Product Notice

1. Adults only

ELFRUFFY is an adults-only store. You must be at least 18 years old and legally entitled to purchase, import, receive, possess and use the selected product in your destination.

We do not sell or deliver nicotine products to minors. Attempts to bypass age verification may result in order cancellation and account restriction.

2. Verification process

Before an order is accepted, the customer may be required to complete online age and identity verification through Yoti, Veriff or another provider displayed at checkout.

Verification may require a valid government-issued identity document, a selfie or other lawful checks. A simple tick box is not sufficient. The carrier may also require identification and adult signature at delivery.

The order name, payment name and delivery recipient should match. A parcel must not be collected or accepted by a person under 18.

3. Nicotine warning

WARNING: This product contains nicotine. Nicotine is a highly addictive substance.

Nicotine products are intended only for adult users. Keep all products, liquids, pouches, pods, cartridges and batteries locked away from children and pets.

Do not swallow e-liquid or expose it to skin or eyes. Follow the manufacturer’s instructions. Seek urgent medical help or poison-control advice after accidental ingestion or significant exposure.

4. Health and use notice

Do not use nicotine products if you are under 18, pregnant or breastfeeding. Persons with cardiovascular conditions, nicotine sensitivity or another relevant medical condition should seek medical advice before use.

The Website does not provide medical advice. Products are not represented as harmless, medicinal or guaranteed to help a person stop smoking.

5. Batteries and devices

Use only compatible charging equipment and follow all safety instructions. Do not use a device or battery that is swollen, leaking, wet, punctured, overheated or visibly damaged. Do not leave batteries charging unattended or expose them to extreme temperatures.

Dispose of batteries and electronic devices through an appropriate collection or recycling system. Do not place lithium batteries in ordinary household waste where prohibited.

6. Destination-country restrictions

Age limits, permitted nicotine strengths, flavours, container sizes, product notification, packaging, advertising and distance-sale rules differ by country. Checkout availability is not a substitute for legal compliance.

We may refuse, restrict or cancel any order that cannot lawfully be sold or delivered. Customers must not resell or supply products to minors.
